Legal Question in Family Law in Illinois

Reimbursement for overpaid child support

A review from the Illinois Child Support Department determined that I was overcharged

$1905 for childsupport. The comments at the bottom of the review read "The overpayment was sent to the custodial parent". I am no longer responsible for any more childsupport. All communications with the Child Support Department has just run me around in circles. Please tell me if there is a way I can retrieve this money that I was overcharged.

Thank You

Re: Reimbursement for overpaid child support

The Illinois Child Support Enforcement

Division made a mistake and the State

of Illinois may be liable. The

State of Illinois can only be sued

in the Illinois Court of Claims. This

is an avenue that you may want to look

into. Generally, the Circuit Court

that deals with child support will

back out of ordering the custodial

parent to return the money.
