Reopen Ruling for Judgement

My son went with his father in November he has refused to let me get my son back. I got a divorce from this person in 2007 and no judgement for the child since, myself and the child lived out of state. I never got an order in the state of texas, and let my child spend time with his father with no custody order. He is now a resident of the state that the divorce was granted in, can the judge reopen the case for the child custody now?

Where was the divorce granted? If it is in IL, then you would file in IL. There has to be something in the divorce file as to the handling of the minor child. Custody is not left undetermined. I would need more information.
