Legal Question in Family Law in Illinois
Retirement
Dear Attorney, December 26, 2008
I am divorced and living in Arizona. The retirement allocation wasnt accomplished at the time of the divorce and now I am seeking an attorney in Kane County, IL to finalize this last step.
Since I am working as a teacher, earning about $30,000 a year, I am extremely careful about my finances. Is this something that I can do myself?
If not, please tell me all your charges up front, the amount of time it will take, will I need to be present for any court meeting, and if you would accept payment once the retirement accounts are transferred to me.
Thank you.

Re: Retirement
This area of the law can be relatively simple to the very complex. It is likely that you need a special type of order, Qualified Domestic Relations Order. It is possible that the dynamics of the pension fund, the holder of the fund(3rd party)and your dissolution terms may make this case costly.
This is technically something you can do by yourself but I would advise against it. Without knowing the complexities of your case my initial retainer would be $500.00. This would cover the cost of reviewing your divorce decree and contacting the appropriate funds administrator to see what we are dealing with.
