Legal Question in Family Law in Illinois

Reversing a Motion to Abate

I signed a Motion to Abate Child Support Payments while my Ex-husband was incarcerated. I did this thinking that it would automatically take care of itself when he was released, but it hasn't. What do I need to do to get this order reversed? I'm tired of begging to get child support money. I am remarried and the ex does not believe I ''need'' it. He has NEVER paid in a consistent manner.

Re: Reversing a Motion to Abate

You need to motion to case back up in court, and send notice to your ex (or the attorney representing him). The notice should include a motion to resume child support. An abatement remains in effect until the court terminates it, and the court will not do that on its own.
