Legal Question in Family Law in Illinois

My rights

My husband is threatening to take everything and leave me with nothing if a divorce would happen. I have a disabled child and I can't work because of her. He is saying he will cancel all ins policies and has taken away all the money and doesn't give me any to do anything. He has hit myself and my 18 yr once already and I am afraid he will do it again.

Re: My rights

Well, he can say one thing but Illinois law has a different perspective. You are entitled to half of all the income earned by him during your marriage. Also, I would argue for him to pay for whatever medical support is needed for the child. And you may be entitled to maintenance.

I do not know all the facts of this case of course, but I can say there is a segment of people that, when confronted with the possibility of divorce, try to be a bully. The problem for such people is that they cannot bully an attorney. I actually enjoy standing up to people who threaten their supposed 'beloved spouse' with penury or physical abuse.
