Legal Question in Family Law in Illinois

rights during seperation

My husband and I have been seperated 14 months. He left the house because he is seeing someone else. I am covered on his health insurance, I am having alot of medical problems and I wonder if he can take me off his insurance when we are seperated. I have no insurance available at my job. Also what is he responsible for paying here at the house( if anything) He does pay child support for our 11 year old daughter, but I don't think it is 20% Is it ever possible for an ex-wife to retain medical insurance for herself for say 2 years following a divorce? We have been married 10 years, do I automatically recieve a portion of his pension or do I need to ask for it in divorce?

Re: rights during seperation

You should really see an attorney. You need to establish what your options are. In short, however, to ensure you retain insurance, you should file for a legal separation or a divorce. This can help you get immediate assistance with child support, spousal support, insurance, etc. As to what you are entitled to overall depends on your situation. You may be entitled to some of his pension, etc. This can be assessed and evaluated by a lawyer. Your attorneys' fees can also possibly be paid by him for the divorce. Contact an attorney!
