Legal Question in Family Law in Illinois
Ex Ruining Credit through nonpayment of mortgage
My boyfriend got divorced two years ago, used ex-wife's lawyer and didn't protect his rights. His ex-wife kept their home, which is in his name, and now is ruining his credit by not paying the mortgage. He is required to pay her child support that would cover the mortgage payment. Is what she is doing legal? Is there a way that he can pay the mortgage payment in place of child support? How can we protect his credit? She also doesn't pay co-pays and medical bills for their children because she knows they're in his name.

Re: Ex Ruining Credit through nonpayment of mortgage
Hello. In my opinion, your boy friend should go back to court and advise the court what his ex is
doing. Certainly your boyfriend needs legal representation. Without seeing the divorce judgment I am unable to determine whether your boyfriend's ex is violating terms of the judgment, but clearly it was not a good idea for your boyfriend to rely upon the advice of his ex's attorney. Will be happy to answer any additional questions that you may have.
