Legal Question in Family Law in Illinois

rule to show cause

I had filed a petition for payment from a court order that was entered that my ex-husband was to pay for my daughters braces. Because I hadn't recieved payment from him in the last 6 months I filed a petition for payment. His attorney filed a motion for it to be dismissed because I did not show cause. Please help I don't know how to write up a proper petition and he gets away with everything because I do not have the means for legally assitance and I am always up agaist a very strong lawyer and I don't know how to do things right. Thanks for your time.

Re: rule to show cause

The petition that you should file

is a Petition For Rule To Show

Cause. In the petition you should

make reference to the fact that the

court already entered an order ordering your daughter's father to

pay for her braces. You should then

attach a copy of the order to your

petition and refer to it as Exhibit A.

You should then ask in your petition

that your daughter's father be held

in contempt for violating the court's

order. If you had to pay for the

braces, you should bring a copy

of the receipt that you received at

the time of payment, and also attach

a copy of this receipt to your

petition.
