Seasonal affective disorder and moving child out of state

I have full custody of my child who is 6, and have also recently been diagnosed with seasonal affective disorder. I have been thinking of moving from Illinois to Arizona because of the severe effects of this disorder during the fall/winter months, but have met some resistance from the father, who only has limited visitation. If I have to go back to court again would the judge take the SAD into consideration? I have been more than willing to work anything out if the father agreed with the move.

A judge will look at all factors in making his or her decision. However, the primary overriding factor is the best interests of the child. A judge would look at the relationship between the child and the father and the impact such a move would have on the relationship. Remember that the best interests of the child are the primary concern.

Yes, it will be considered but only as to the effect it has on the best interests of the child because that is what the judge must base his decision on.
