my sister is in jail charge as sex offender, she wants to ask her husband for divorce, but she is afraind they will take their children away. who will have custody in this case?

It depends on the facts of the case. What kind of sex offender is she? Did she abuse her children? Is there some reason why father shouldn't have custody? How old are the children?
