Legal Question in Family Law in Illinois

I have sole custody of my two young children and their dad gets supervised visitation and there is an O.P. against him to protect myself and my children. I have recently had some medical problems and my parents offered to take temporary guardianship of my children. How can I give my parents temporary guardianship so that my kids can live with them and go to school there and receive medically treatment there? We live in Illinois and my parents are about 2 hours from me. Is guardianship necessary or can my kids live with my parents temporarily (several months) and attend school and receive medical treatment there without my parents having guardianship?

You don't say whether this is a divorce, parentage case or simply an OOP case. You also don't say whether two hours away is inside or outside the State of Illinois. The answer to your question could be very different depending on how you answer those questions. You need to contact an attorney in your area and sit down with him or her and work out a plan that will protect your children without making it seem that you are sending the children away to prevent their father from having contact with them. Your parents may also have to agree to transport the children to Dad's location so he can visit with them pursuant to the terms of his supervised visitation. Too many variables to give you a definitive answer to your questions. Hire a lawyer immediately and certainly before shipping your children off to their grandparents.
