Legal Question in Family Law in Illinois
I need help getting my son back from his father
I moved to Chicago i was going to bring my son too from TX. I was going to come for a week to get enrolled in school and get on public aid. I left my son in texas with my mom. She took him to his dads who also lives in TX for a few days and he wouldnt give him back and still wont. This was in Feb. Ive called legal aid and carpls and american bar asociation. No one can help me. He is sueing me now. I just turned 18 on jun 29th i got the citation on friday. I was still 17 and he filed the citation jun 9th. Could he do that if i was 17? and if he was abusive will i win even though it was before the baby was born? and if i dont have a job will he win? i dont know what to do or how to do it? the citation says i have to file a written answer with the clerk who issued the citation by the monday next following the expiration of twenty days after i was served the citation and petition, a default judgment may be taken against me. How do i do that and what does it mean?

Hello. My best advice is to get a lawyer to represent you in Texas. Contact Texas Southern University's law school (legal clinic) or University of Houston law school. Both might be able to give you a referral. Trying to protect your rights here, without legal help there, is not the best move. Will be happy to discuss this further and in more detail.
