Legal Question in Family Law in Illinois

My Son

briefly, I acknowledged parentage in open court plus filed the paper work. My son is now 5, his mother agreed to joint custody , vebal no court order. I have been financially responsible, emotionally, health and active with his school. Mom has attempted sucide on two ocassions, one documented by police reports. I intend to file for custody due to her recent issues with his school and bad decisions. She has allowed a boyfriend to sleep at her residence that she has known for two months. My son called me hysterical last week while at her residence at 11 pm , my return call was ignored by his mother. I sent the police for a well being check, the next day my son articulated he was scared and wouldnt go into his mother room because there was a man in the bed with her...Suggestions as a single father. Mom has been diagonised with Bi polar and other isssues and is on several meds..

If paternity has already been acknowledged, who could proceed with the next step and file for custody especially since it sounds like that the best interest of the child would be better with you as a custodial parent.
