my son

i'm the only dad he knows. i guess i didn't express my self correctly. let me try again. in february 1999 i met this lady...she has a 13 month old son...thing progress between us...we start a relationship...the biological father of her 13 month old son comes around once or twice in the same year we met...it's now 2008...which is 9+ years later...her son is now 10 years old...he has only known me to be his dad...last time his biological father saw him was the once or twice in the year of 1999...so basically it's been 10 years...i want his biological father to give up his parental right since his name is on the birth certificate...so i can change his last name to mine. i have no relation to his biological father...we have never asked for child support nor do we need it. i just don't want his biological father to atempt to come between ''MY'' son and i after 10 years of not being there. what should i do?? what can i do?? i also have a six year old(bilogical) from the same woman...i just don't want my big boy to feel left out with a different last name. he may not be my biological son, but he is my son 100%

The process you need to begin is to terminate parental rights. Its a contested process, since you are taking away a parents rights. The biological parent has to be notified and has the right to fight it. From the sounds of it, you will very likely win, but you have to follow the process carefully.
