Legal Question in Family Law in Illinois

My son and I are originally from Canada. We moved to Ilinois about 2 years ago, because I got married. My son's father lives in Alberta, Canada still, and has not had any contact with him for 1yr and 3 months. Can I file for abandonment, and do I have to do it in Canada?

No seeing his son when you move may not be abandonment. I do not know Canadian law, but does Canadian law require you to obtain approval from him or the court and did you obtain that approval in writing. If not you may be in the wrong and he may not be guilty of abandonment.
