Legal Question in Family Law in Illinois

Should now be later?

I have a son from a previous relationship who is 16, I also have a son by my husband who is 2. my 1st son's father is not around, and has been in&out of jail since he was born so he has never been around. my husband has been taking care of my 1st born every since he was 8 includung his healthcare. my son want's his last name changed to his step-father's last name even though he has my maiden name ( i am the only one on the birth certificate). By him being 16, should we go through the courts now and change his last name? or could we wait 2 yrs and change it at 18. And if so, what is to be done first?

Re: Should now be later?

Hello. You can change his name now. At this

age you will not have to publish for creditors

so there should be some financial savings by

doing it now. This process begins with the filing of a change of name petition and there

are court costs, etc. This process can move

quickly. In my opinion, there is no benefit

in waiting until your son is 18. If you have

any more questions, I will be happy to respond.
