Legal Question in Family Law in Illinois

My ex and I have a son who is 2 years old. She is currently in school out of state and I am here where my son is. She has not let me see him for the past 3 or so months even though I constantly ask her to. She has denied me this right. Instead, she leaves my son with her dad. If I recall, I didn't sign any document stating he was a legal guardian. She is gone for 5 months more or less, only visiting when she has break or on holidays. What can I do?

Is there a court order for visitation? If not, You need to file a Petition seeking visitation, The mother has to be served with summons, and the court will order visitation, absent some legitimate reason for denying it, such as being a convicted sex offender with respect to the child..
