Legal Question in Family Law in Illinois

Spousal support

An order has been entered for spusal suport to begin at retirement age for me to continue for 180 months, however, it does not address the needs now. Can a spousal support order be modified to begin earlier and can there be a lump sum payment?

Re: Spousal support

It is not clear why the order does not address present needs for spousal support. If the order is a final judgment, modification of the order must be based on a substantial change of circumstances. If the order is not a final judgment, you can request the court to reconsider its order. After 30 days, you likely lose any basis to request the court to reconsider the order. Since time is of the essence, you are advised to consult with an attorney if you aren't represented in this matter.
