Spouse Not In The Country

Do I need an attorney to file for divorce if my husband was deported back to Mexico and I don't have an address for him? We have a minor child together as well as another child that is not biologically his.

In the State of Illinois, there is no requirement to have an attorney for a divorce action. However, the process can be somewhat complicated and there is no requirement by the court to help you through the process...In fact they cannot give any legal advice.

If you do wish to proceed to go forward without an attorney, you need to do some research. One of the best places to do legal research is at your courthouse in the law library.

Divorcing a missing spouse

You are never REQUIRED to have a lawyer to file for and obtain a divorce, but it�s a good idea, particularly in a case such as you describe. A divorce is possible even where a spouse has disappeared, provided the proper steps are taken to attempt to locate him and thereafter publish the proper notice of the divorce action.
