Legal Question in Family Law in Illinois

My spouse filed a petition for dissolution of married. In my appearance and response I want to file a counter petition for dissolution of marriage. Being that she filed do I put me as the petitioner and my spouse as the respondent? Or do I put it as it was being she filed?

The caption always stays the same, - she is the petitioner and you the respondent. If you want to file a counter-petition, you need leave of court - the caption would be wife, petitioner-counter-respondent and you - respondent- counter -petitioner.
