Legal Question in Family Law in Illinois
Hi, I am trying to start the proceedings to gain custody of my children back and want to know if you think I seriously have a chance. DCFS of Illinois supposedly said that I am on an unfit parent list and I got my children taken away from me by my mother, currently I am on and have been since I was 18, now 25 yrs of age, on Social Security Disability and make a mere 890 a month and at first I was on SSI because I have major depression and bi-bolar disorder, 1 doctor and I unfortunately have no proof says I am no longer depressed, but I have to get routine blood transfusions because I have a severe case of thalisimia and I also have a hole in my heart that could worsen. They were originally taken from me because my ex-boyfriend/ 2nd child's father beat my daughter who was at the time 4years old, they tried to charge me with emotional, physical and verbal abuse as well as neglect but she is now 10 going on 11 in March and the case is still open as far as I know. Do you honestly think I can get my children back?

Not likely but you may be able to get additional visitation time with them provided that you are "clean & sober" and that the BF is no longer in the picture. Your children were not taken away from you by your mother - they were placed with your mother by DCFS on the theory that children are best placed with other family members. Your mother was tasked with taking care of them as you were not able to do so. If you have that doctor's name his diagnosis may be of some help to you but most importantly you need to reconnect with your caseworker and make the appropriate inquires and comply with the program designed by DCFS and the juvenile court.
