state custody laws

My female friend lost residential custody of her 3 girls, in florida over her being depressed, In Illinois ,can she have a good chance of getting residential custody? her ex is living with her but keeps on threatening her with leaving the state, or giving her money. JMB Hillside

I am not certain of the circumstances here. If she lost custody in FL, but then both her and the ex moved to IL and live together with the children, then IL now has jurisdiction. If that is the case, she could bring a petition in IL court to change the custodial situation. Important to this situation is her needing to establish some sort of custody in order to prevent the ex from easily being allowed by the courts down the road to leave the state.
