Legal Question in Family Law in Illinois

stepkids

husband and i are splitting up, he has 2 daughters i have been raising for 4 yrs. he has sole custody, they have no contact w/birthmom(addict) r my stepdaughters legally able to keep living w/me the stepmom without their father if he agree's? or if their birth mom found out or her family could they legally then fight to get the kids back rather than have me the step mom raising them without their dad? the kids are 9 and 15,please letme know??

If you want to have superior rights to the kids over the birth mother, it would probably be a good idea to adopt the kids. Yes, if father agrees you can probably have the kids with you, but that is subject to the birthmother not contesting it. You will need to get a guardianship, and in order to do that, both parents need to be notified. This is something you should really consult a local attorney about.
