Legal Question in Family Law in Illinois
Can I stop my child support on my own?
My divorce decree states until the child reaches eighteen or graduates
from high school,whichever event
occurs last. The child turned 18,and
graduates in May. And it doesn't say
anything about college. My ex-does
not plan to modify our order.
My support payment comes auto-
matically out thru my employer.
What do I need to do to stop this
when its time?
Would you suggest I obtain an
attorney?

Re: Can I stop my child support on my own?
Your decree is not in conformance with the state statute that provides for child support to continue until age 21 unless the child is emancipated. Ths statute sets forth the criteria for emancipation.
I suggest that you contact an attorney to take care of this since your order does not follow existing law and the attroney will be able to determine whether an emancipation will take place.
