Legal Question in Family Law in Illinois

being sued

My ex sister-in-law thinks that she is entitled to money from the sale of our family home that was left to my four brothers and myself following my mother's death in 2001.

We had not put the house on the market before because my nephew (her son) was living in the house with his father. He wanted to move in with his mother in October, 2006 (15 years old at the time) because he didn't want to go to school.

My brother had borrowed against his share of the house repeatedly over the years to the point where he signed his share of the house over to me and my other two brothers. A lawyer took care of this transaction.

One brother the three of us bought out so that he could move out. The brother who signed his share over moved with him to Wisconsin (from Illinois) because his only other option would be the street. He's bi-polar and self medicates with vodka. He lost his job in December, 2006.

Because he has not been paying child support since his son (who has legal custody of) moved out in October, 2006.

Since it's obvious to my ex sister-in-law that her ex-husband hasn't any money and can't pay child support, can't get a job to pay child support, etc., she is coming after me and my share of the house.

Re: being sued

Your situation is a bit complicated, but if the transactions you describe were done properly, you should be fine. The key is to show you (or whoever) paid a fair amount for the brother's share.
