Legal Question in Family Law in Illinois

Suing for full custody

Can a father file for sole custody of his two children if he finds the mother to be unfit? What's the procedure and how long does family court last?

Re: Suing for full custody

Sure. If custody was initially set within two years it's a more difficult standard. If beyond two years the standard is, substantial change in circumstances since initial custody & it's in the best interests of the children. Has there been a big change since custody was initially set?

As for procedure, you file for Change of Custody with the court. If she'd agree to it, it could take one month. If there's a fight, it could take a year or more.
