If I am summoned to appear in court for proof of paternity and the petitioner is not there, is the case thrown out?

Hello. If the petitioner does not appear, that does not mean that the case is over. The court may allow a continuance for the petitioner to appear at a later date. Even if the case is dismissed, the petitioner at a later date, can re-file the case. It is best to pursue the case on your own and have the court order you and the petitioner to submit to a DNA test. If you wait, and the petitioner re-files several years later, you could be facing a huge child support bill if it is determined that you are the father of the child. Will be happy to discuss this further and in more detail.
