Hello. If the petitioner does not appear, that does not mean that the case is over. The court may allow a continuance for the petitioner to appear at a later date. Even if the case is dismissed, the petitioner at a later date, can re-file the case. It is best to pursue the case on your own and have the court order you and the petitioner to submit to a DNA test. If you wait, and the petitioner re-files several years later, you could be facing a huge child support bill if it is determined that you are the father of the child.
