Summons question

I am having my husband served divorce papers. He is telling me he will not sign them. That he will take me to court until all of my monies have run out. It says if he does not respond that a summons will be served. Once a summons is served will he have to sign the papers?

A divorce in many ways is just like any other lawsuit. Both parties have every right to litigate and defend under our law. If your husband gets served with a Summons he has 30 days to Respond to your Petition. If he doesn't Respond than you may be able to get a divorce by default. There are many different ways that a divorce can proceed. A party can but is not required to do it merely by agreement.
