Legal Question in Family Law in Illinois

support for disabled

I have been considering divorcing my husband. During the past 20 years I have been unable to work due to an immune disease. My husband throws this in my face constantly, that he does not have to pay support if we divorce. what is the law on spousal support when the one requesting the divorce is physically unable to work because of illness? Right now we have great insurance through his job, would he be obligated in any way to keep me on his insurance?

Re: support for disabled

Helo. Your husband probably will be obligated

to provide you with maintenance which used to be

called alimony in Illinois. In other words, he

probably will be unable to just walk away and

leave you without support. Divorce is a serious

step. You should think about this very carefully, before you make a move. Illinois is

a marital property state. You would be entitled

to 1/2 of what is acquired during the marriage,

regardless of whether your husband paid for it.

I will be happy to answer any additional questions that you may have.
