Legal Question in Family Law in Illinois

Temporary custody forms

I have a family member who went to jail for 4 years and has 2 children, and his wife is going thru breast cancer and they want me to care for them till he gets out or she possibly gets better, we don't want then to become the ward of the state so she is willing to sign temporary custody papaers and I need to know how we can do this without all the Attorneys and fees. Can we just write up something on our own and have them notorized for this to be considered legal? Please help need answer ASAP if possible has to be completed before friday.

Thank You.

Re: Temporary custody forms

The last time I checked the State of Illinois has a provision for "Short Term Guardianship" This means that the parents of the children can appoint someone to become the legal guardian of the children for up to 60 days. If you need additional information I suggest you visit www.illinoislegalaid.org. You can find additional information regarding guarianships and I believe you might beable to find the Short Term Guardian form. You will need to complete the form and have it witnessed by at least two persons over the age of 18 and neither witness can be the person designated to be the short term guardian.
