Legal Question in Family Law in Illinois

Temporary Custody

My granddaughter who has lived with her mother (my daughter) for 5 years has been staying with her dad for the past 5-6 months. He has filed and was awarded temporary custody and stoppage of child support (he is also in arrears). In the motion filed on his behalf, he stated many false statements. My daughter was living in Texas and was served with court papers the night before the hearing. (She has just moved back to Illinois.) We could not find legal rep for her that quickly, so her dad went on her behalf and was denied any right to speak -- so there was no one there to contest the motion for temp custody, which was granted. Will it be difficult to be awarded back custody?

Temporary Custody

There are far too many unanswered questions for me to predict whether child custody can be regained. Since the fathers award of custody is temporary, its probably not too late to turn this around. In any event, you need to prepare for a permanent custody proceeding. Bring this matter to an attorney right away. Do not delay.
