Legal Question in Family Law in Illinois

Termination of parental rights

If I file for child abandonment against my son's father will this terminate his parental rights automatically, if the judge rules that? If it does terminate the rights & my husband adopts my son does my son's father still have to consent to the adoption? Can I file for child abandonment by myself or do I need a lawyer?

Re: Termination of parental rights

Filing for abandonment, and essentially trying to get one person replaced by another person as the child's legal parent (along with all the rights and responsibilities of that) is a serious matter.

You do not need the biological parent to consent. If no no shows, its defaulted in your favor. If he fights it, everyone goes to court and talks to the judge.

Also, you want to make sure that the paperwork is compliant, and isn't undone 10 years from now.

So I am biased because I am an attorney. But I also am in the process of handling several matters just like yours, and I doubt you want to handle a matter like this without experience.
