Legal Question in Family Law in Illinois

texting

I texted my wife after we got divorced many times, and the texts were not threatening of any nature. She filed charges of disorderly conduct in Violation of 720 paragraph 5/26-1(a) (1). The charges were filed by the assistant's state attorney. My wife claims she didn't file charges. However a while back she did have a cop call me and say quit texting. Regrettfully, since then I had texted some more, again non-threatening texts. 2 questions. 1. Wouldn't my wife have to be the one to file charges? and 2. What puishment is forseeable with a disorderly conduct charge?

Apparently your wife filed a complaint with her local police department. She may claim that she didn't file charges but she did sign a complaint which is the same thing. The usual punishment for a D/C charge is a $75.00 fine or a day in jail. If you think these people are kidding, the next time its likely to be a violation of an OOP or harassment. Leave the ex alone!!!!!!!!!!!
