Legal Question in Family Law in Illinois
Hi there,
I am now a single mom and i am going through a divorce. I already have a lawyer which i do not like at all and i am wanting to switch. i have special request on my divoice and she says no to everything. She is a free lawyer that i have which make me think she really doesen't want to do anything and just file the divoice the simplest way possible. I rather pay some one to do the job right.
I just got in to a fight with my soon to be ex-husband because he does not want to give me money. We have a 10 month old daughter and he comes by and sees her ever week or two weeks. When he is with her he never picks up my calls and he always says that he has no batterie. I pay a baby sitter and not to mention her nessesities and medical. I want Justice for what he did to me and i want full custody of her. I have a good stable job, my own house & car. i had to put college on pause becasue of my pregnacy. on the other hand he has never had a consitant job, no school, barely made it through high school, horrible credit, he currently has a part time which isn't sufficen't when carring for a baby but he doesn't care because he lives with his parents. doesn't even have a crib for the baby.
The only thing i want is justice and what i rightfully should get as a single mom. It isn't fair for him to just have a baby with me and then leaving me 4 months pregnant.

what do you define as justice. The law defines justice as he having to pay you 20% of his net income as child support. In addition he is required to maintain medical insurance for the child (or put the child on KID CARE) and may be ordered to pay some of your day care expenses. He will be allowed visitation with his child, but no court will sanction him if does not show up. You were an equal party to this act and have to accept the reality that you chose him as a partner, even if it was for a very short period of time.
