Legal Question in Family Law in Illinois

Not told of hearing date?

My ex husband who failed to show up for two visitations in a row, is taking me to court for something and I have no idea what. He says he sent to me a letter regarding the date and everything but I never received it. What can I do?

Illinois Supreme Court Rules require that you receive notice of motions/hearings in advance. The notice would have told you when and where a hearing would be held and what the purpose of the hearing is. If you had a lawyer in prior proceedings between you and your ex (and the lawyer has not been granted leave to withdraw as your counsel), the notice would be sent to him or her instead of you.

You can always find out what has been filed in your case by looking at the court file located in the circuit court clerks office. The entire case file (pleadings, court orders, notices, other court filings) will be there. If you think a hearing is coming up, you can find out about it, including the date and place of hearing, from the circuit court clerk.
