Legal Question in Family Law in Illinois

Uncontested Divorce

I am seeking an uncontested divorce and my husband won't sign the papers. If I sign them and have them notarized, am I breaking the law? Would the divorce be declared invalid? He gave me verbal permission to sign them, does that make a difference?

Re: Uncontested Divorce

Hello. If your husband will not sign the paper-

work, you should definitely not sign for him. That would be forgery and you could be sanctioned by the court. You need to retain a

lawyer and have your husband served with a

petition for dissolution of marriage and a summons. If your husband won't sign the paper-

work, it is definitely contested. Will be happy

to discuss this futher.
