Legal Question in Family Law in Illinois

Unmarried, Pregnant and Moving out of State

I currently live in Illinois but just got a job offer in New York and will be moving soon. I'm 3 months pregnant with my exboyfriend's child. What are the laws about moving out of state when you're pregnant? Where would I file for child suppport and custody issues? My ex has expressed an interest in being a part of the baby's life but I dont know how that can work with a newborn and with him being so far away. Help please!

You would file for support where you have the baby. Assuming you do not want to establish parentage prior to birth (amnio), then child support does not apply until there is a legal child (at birth). As to being involved in the child's life, as long as the father is not abusive, it is almost always in the best interest of the child to have his father in his life.

On a non-legal note, I also want to say I respect your decision to have your baby given your situation. There are a lot of support organizations and free aid for people in your situation. Good luck with everything!

File in the state where the baby is born. Be careful not to come back to Illinois. Contacts here could force you to com back here with the child.
