unpaid child support
I was awarded sole custody of our 3 kids and the court gave me permission to move back to NY state with the kids. My ex was ordered to pay child support and for half of the uncovered medical and dental. He is 3 years behind in child support and 8 years behind in the medical and dental. However, the court in IL refuses to enforce this. I tried to have the case transferred to NY under the Uniform Child custody Jurisdiction Act only to have the IL judge refuse to give up jurisidiction. My question is how can I collect on these things when the IL court keeps postponing it and when it does come up before the judge, all he does is tell him to pay the debt. He could put him in jail, but doesn;'t. Any help in this matter would be greatly appreciated.

You need an attorney in Illinois to petition the court to essentially punish the father, deduct money from his income, place liens, take away his license, etc. No court has the manpower to go after every deadbeat on their own, nor could they ethically, since they are the judges, and can only grant or deny requests from people. We represent a good number of clients who are out of state and are trying to collect from IL deadbeats. Let me know if you have any other questions.
