Legal Question in Family Law in Illinois

Vacating a Bench Warrant

I have been found in contempt of court for failure to appear. Since that time I have negotiated a settlement with the plaitiff who agreed to drop the suit. does this action or any other cicumstances satisfy the bench warrant and relieve me of responsibility for the contempt charge in this civil matter?

Re: Vacating a Bench Warrant

The matter would have to be looked into and perhaps an ex parte hearing with the judge to have the contempt order vacated. Please contact me directly at (619) 222-3504.

Re: Vacating a Bench Warrant

Ask the other party to take the matter off calendar and have the bench warrant recalled.

As a general rule if the party that brings the motion for contempt requests that the warrant be recalled and the matter taken off calendar the court is willing to do so. It it ultimatleyh up to the judge.
