Vacation to Mexico
The mother (born in Mexico)of my Daughter (born in the U.S) would like to take my daughter to Mexico for vacation, I just got sole custody of my six (6) year old less than a year ago, the mother had threatened to take my daughter away in the past and is now taking me to court in order to get a passport for the child. I have looked over the Hague convection and see that Mexico has not been in complacence with the convection. Can I do anything to stop this trip or to prevent the child being abducted while in Mexico?

If there is a credible and reasonable fear that the Mother will take the child to Mexico and will not be returning, then you should file a motion with the court to prevent her or not allow the Mother to remove the child from the State of Illinois.

Yes. But it will require you to show why you are concerned about your wife leaving the country. Given the fact you have not had custody until less then a year ago, you can argue that she is mad about losing custody and is trying to take her out of the reach of the courts here. I am very nervous about Mexico, as it is a third world country without the same rules and laws here. Let me know if you have any other questions.
