Visitation and name change
I have a 5 mo old daughter. Her dad and I have never been married. We had arranged our own visitations, but he never showed up. He was recently took me to court and was ordered to pay child support but I have not yet received it (I have not received any support). He wants her last name changed to his and he wants to be able to pick her up, but he lives in a shelter now and we live 2 hours apart. Can a judge make me change her last name and will they let him take her to a shelter? I have three other kids with my name at home and I have full custody of the baby. I want his visits at my home or supervised if outside of my home.

Hello. In my opinion, after over 20
years of practicing law in Illinois, the judge cannot force you to change the last name of your child to that of dad. I think you will prevail in your efforts to get visitation between dad and child to take place at your home. It will help to have
a formal visitation order. Will be happy to discuss this further and in more detail.
