Legal Question in Family Law in Illinois

Visitation and child support

I am currently in a middle of a divorce and we have a 8 month old baby. Does the father who hasn't paid child support have the right to fight for visitation?

Re: Visitation and child support

Hello. Yes, the father has a right to fight for custody even though he

is delinquent in payment of child support. The law views child support, visitation and custody as distinct and separate issues for the court to consider. Will be happy to discuss this further and in more detail.
