Legal Question in Family Law in Illinois

Visitation

I relocated to the state of California with my nine year old daughter in January due to a job transfer. Her father and I were never married but have always had an amicable relationship concerning her. Orginally her father approved of our move but now wants her to come back to Illinois saying it was illegal for me to take her. He now wants to go to court. 1. Did I break any laws moving out of state? If so, what are the consequences for doing so? 2. What measures do I need to take from this point forward? I do allow him visitation and our original agreement was for her to stay with him during the sumer, spring break and alternating holidays. The current child support order gives alternating weekends for visitation. HELP!

Re: Visitation

I do not think you broke any laws. It may be that he can ask the court to have you return to te state. The court will then determine what is in the best interests of the child. If you have made arrangements for the child to have additional visitation with the father so as to minmize the impact on the visitation you are probably okay.

If the do do hits the fan, I can help you on this end. I charge $250 per hour to work on these types of cases. See my web site for contact info, Lomap.com
