Visitation Rights removed due to second hand smoke

Can my ex take me back to court to have my visitiation rights revoked because I am a smoker? My ex is not a smoker and does not want our son around cigarette smoke. Would a judge agree with her and say I could not have visits with my son? Please advise, I am very worried.

Hello. In my opinion a judge would not revoke

your visitation rights with your child because

you are a smoker. We are exposed to automobile

exhaust, U.V. rays, etc. Your child's best

interest in seeing you far outways the risk

of cigarette smoke.
