Legal Question in Family Law in Illinois
visitation
My 15 yr. old daughter does not want to spend the amount of time with her mother, the non custodial parent, agreed upon in our divorce agreement. Is she of sufficient age to make this determination?

Re: visitation
She cannot unilaterally make this decision. If she wants to spend less time and her mother is not in agreement, you need to petition the court to modify visitation.

Re: visitation
Yes, but you have to go to court on her behalf and give her the opportunity to tell the judge. I am simplifying it, but this process occurs all the time.
