Legal Question in Family Law in Illinois

My ex wife currently has custody of our three kids (15, 8 and 4). My oldest has told me that they have been left alone for 4-5 days at a time with no money and no food. This has happened more than once. She tells them she doesn't have money to buy food but then she goes out to the bar the same evening. I am now living in Texas and would like to get custody of them and have them come to Texas and live with me. What is my first step?

I am assuming that she lives in Illinois. If that is the case, you will need to file a Petition to modify custody. Depending on how long it has been since the court initially determined custody, there are different standards that apply to your petition.
