Legal Question in Family Law in Illinois
My wife and I were getting divorced and decided to reconcile.
Her attorney said she has to fill out a paper stating she longer wishes to go forward. Her sister is friends with the attorney and does not feel my wife is cometent to make this decision and has tried to interfere by contacting the attorney. The attorney talked to her sister about this case including giving information on what my wife and he have had conversations about.. Is this legal and does it break the attorney client priveledge.The attorney's office claims they sent the paperwork including her partial retainer refund over a week ago but has not yet arrived. Mail from that area usually takes only 1 to 2 days. We think her sister had the attorney send everything to her. If this is the case, what legal recourse do we have. The attornies office doesn't return phone calls so follow up is nearly impossible.

Sometimes it is legal to speak with a family member about your divorce. It just depends on what the attorney is talking about, and whether or not the client is present during the conversation. It sounds like your wife may need to fire her attorney, if she hasn't done so already. The best solution for getting your wife's paperwork and retainer refund is to go to the attorneys office and get it in person. He can always cancel the previous check that he claims to have sent out.
