Legal Question in Family Law in Illinois

My wife and I live in Illinois. I have 3 step kids. My wife wants to move out of state but her ex is not allowing it. Is there anything we can do?

She can not move without her ex's approval or an order of court. Illinois does not permit a divorced custodial parent to leave the state (remove) without either of the above. She must petition the court for permission to leave - and the burden is on you and your wife to show the court my the removal is in the best interest of the minor children. It is not a simple issue. It also may depend on where you live in this state. Different areas may have different standards.
