What will happen to my children if me and their father die and we dont have a wi
My boyfriend and I have lived together for 7 years and have two children together ages 2 and 4. We are not married and do not plan on getting married, we love each other but this is beside the point. An elder that i work with keeps bringing up this idea that if we were both to die our children would to the state. She says my children will suffer and go to the state and my family will never know what happened to them. I find this way out in left field, but i am young and have no clue. My family has their own legal advice and such, and they have never brought this up to me. I have and Aunt and Uncle that helped me buy my house, and they bound my house to my children, if this question is true, i would have thought that this would have came up before now. My family knows that we are not even thinking about getting married and wont for a while if ever, and never brought up such and idea. My family and his would definitly take our children with no question. I have never considered a will. My family and his are finicially stable by a long shot. In the state of Illinois what would happen to our children. I always thought that they would go to our family, i dont want to think about all the things of death, i am 25.

You need to speak with an attorney so that a Will and other documents are prepared to protect your children and so that your wishes are honored. Strange things can happen once you are no longer in the picture so you need to have at least a simple Will prepared.
