Legal Question in Family Law in Illinois

I was wondering how I would go about changing my minor sons last name. I have full custody of him and his biological father has no contact with him, and has not for at least 8 years. I want to just change his last name.

You are required to give notice to the father. A judge has the discretion to deny your request. If you are saving you have no idea where father is and he is not paying any support, you may have an easier time. You would be filing a Change of Name action, which requires publication notice. The Clerk in your local courthouse will assist you. An attorney is not required
